DuPont Forced to Pay $5.1 Million to Cancer Victim of PFOA
On July 6th, 2016, a United States jury ordered the chemical giant DuPont to pay 5.1 million dollars to David Freeman, an Ohio resident who claimed he contracted testicular cancer due to his exposure to C-8 in drinking water. C-8, also known as PFOA and perfluorooctanoic acid is used to make a number of products, most notably, Teflon non-stick cookware.
The jury took less than one day to deliberate before finding DuPont guilty of negligence. But what is more telling is the fact that the jury also decided that DuPont had acted with malice.
This finding now opens the company to punitive damages. A separate proceeding will determine the amount of those damages.

While a DuPont spokesman declined to comment, a spokeswoman for Chemours, a spin-off of DuPont’s chemicals segment stated that the new company will cover DuPont’s liability and that the verdict will be appealed.
The trial has largely been viewed as a legal bellweather which will help both the companies and the plaintiffs analyze and evaluate their current cases surrounding similar instances.
DuPont is currently facing more than 3,400 lawsuits from residents claiming they have contracted one of six diseases linked to PFOA. The first trial over C-8 exposure took place in 2015 also resulted in a $1.6 million dollar verdict for the plaintiff. No punitive damages were awarded at the time.
